Bactenix® V300, NABC’s erythromycin-based product, is the only antibiotic FAP accepted for filing by the FDA/CVM

Duluth, GA – August 30, 2010 – North American Bioproducts Corporation (NABC) has received notification from the FDA/CVM that its food additive petition for erythromycin thiocyanate was accepted for filing. Therefore, NABC is the first and only company to have its FAP considered complete and subsequently accepted by the agency for filing. A notice of the filing was published in the United States Federal Register* pursuant to regulation 571.1(i)(2) in Title 21 of the Code of Federal Regulations.

In 2008 and 2009, the FDA/CVM gave clear direction to the ethanol industry and certain antibiotic suppliers that because they can reasonably be expected to become a component of the feed, i.e. distiller by-product, antibiotics are considered food additives and expressly stated that antibiotics are not recognized as GRAS for use in Fuel Ethanol Production.

Dr. Sanjoy Ganguly, NABC’s V.P. of Technology states “This is not yet an approval, but we are pleased with NABC’s unique status of having the only FAP accepted to date”.
